USCIS recently approved a Change of Status to E-2 for spouse of principal E2 visa holder doing business in the state of Michigan. The E2 spouse was granted the E2 status for 2 years, the maximum period allowed for change of status to E2 under the current law. For this E2 case where the spouse was in the United States, the USCIS approved the case without a Request for Further Evidence (RFE). The overall processing time was 5 months.
The E-2 Treaty Investor Visa is a U.S. nonimmigrant visa designed for individuals who make an investment in a commercial enterprise in the United States. The E-2 Investor Visa allows a national of a treaty country to temporary come to the United States together with their spouses and children to live and work. The E2 spouse has an unrestricted right to work in the United States for the duration of the E2 status.
