Overview of Executive Order
Executive Order 14399, signed on March 31, 2026, represents a significant shift in the federal government’s role in overseeing the integrity of the United States electoral process. Titled “Ensuring Citizenship Verification and Integrity in Federal Elections,” this executive order establishes new federal mandates to ensure that only U.S. citizens participate in federal elections. It requires Department of Homeland Security (DHS) and the Social Security Administration (SSA) to send a list of U.S. citizens eligible to vote in federal elections to state elections officials. The order focuses on three primary pillars: citizenship verification infrastructure, mail-in ballot tracking technology, and strict federal prosecution for election-related fraud.
Key Provisions of the Order
Creation of State Citizenship Lists
DHS and the Social Security Administration (SSA) are directed to compile a State Citizenship List.
- Data Integration: The State Citizenships Lists are derived from citizenship and naturalization records, SSA data, the SAVE program and other Federal databases.
- State Transmission: Verified lists of US citizens (18+) must be sent to the chief election officials of each state at least 60 days before a federal election.
- Data Correction: The order requires DHS to establish procedures allowing citizens to access, update, or correct their individual records, ensuring that clerical errors do not impede the right to vote.
- Important Note: While the list confirms citizenship, it does not automatically register a person to vote and it does not indicate that the individual has been properly registered to vote in
- the State. State and federal laws and state procedures must still be followed for an individual to be registered to vote.
USPS Mail-In Ballot Security Standards
The Postmaster General is mandated to initiate rulemaking to secure the United States Postal Service (USPS) as a medium for absentee voting. To prevent the unlawful use of mail for election fraud, the order mandates:
- Intelligent Mail Barcodes: All outbound ballots must use Intelligent Mail barcodes for tracking.
- Official Election Mail Branding: Envelopes must be marked with the “Official Election Mail” logo and pass USPS design reviews.
- Verification: The USPS will maintain a Mail-In and Absentee Participation List to cross-reference eligible voters with transmitted ballots.
- Rulemaking Deadline: The USPS is required to initiate these changes through a formal rulemaking process within 60 days of the order, with final rules issued no later than 120 days post-signing.
Federal Enforcement and Criminal Prosecution
The Attorney General is granted expanded priority to investigate and prosecute state officials, private contractors, or individuals who facilitate the distribution of ballots to ineligible voters. A critical enforcement mechanism is the withholding of federal funds from states or localities that fail to comply with these verification standards. Furthermore, the order establishes a five-year record retention policy for all materials related to voter participation, ensuring a long-term audit trail for federal oversight.
