On January 4, 2023, the United States Citizenship & Immigration Services (USCIS) released Form I-956K, Registration for Direct and Third-Party Promoters. The form was released as part of the EB-5 Reform and Integrity Act of 2022 and must be filled and submitted by each person acting as a direct or third-party promoter (including migration agents) of:
- A regional center;
- A new commercial enterprise;
- An affiliated job-creating entity; or
- An issuer of securities intended to be offered to immigrant investors in connection with a particular capital investment project.
The form asks promoters of investment products related to the EB-5 green card through investment program to provide personal information, contact information, information about their employer or association and a number of questions related to disciplinary actions by securities regulators and/or criminal convictions. In addition, the Form I-956K requires the promoter to disclose details about their written agreement with each regional center, new commercial enterprise, and affiliated job-creating entity.
