1. Do Dependent Spouses Need an EAD to Work in the U.S.?
L-2, E-1, E-2, and E-3 Spouses
Under updated Department of Homeland Security (DHS) policy, dependent spouses holding L-2, E-1, E-2, or E-3 status are authorized to work automatically incident to their nonimmigrant status.
- Form I-9 Verification: Spouses can present an unexpired Form I-94 featuring an “S” designation (such as L-2S, E-1S, E-2S, or E-3S) to their employer. This serves as an acceptable List C document for Form I-9.
- Optional EAD Filing: Applying for a standalone EAD card (Form I-765) is entirely optional. However, an EAD card provides an independent List A document combining proof of identity and employment authorization.

H-4 Spouses
H-4 spouses are not employment authorized incident to status.
- An H-4 spouse must file Form I-765 and receive a valid, unexpired EAD card (Category C26) from USCIS before starting any job in the U.S.
- H-4 eligibility for an EAD is restricted to spouses of H-1B principal status holders who have an approved Form I-140 Immigrant Petition or have extended their status beyond six years under AC21 provisions.

2. Automatic EAD Extension Rules While Renewal is Pending
Qualifying H-4, L-2, E-1, E-2, and E-3 spouses who choose or are required to renew their EAD card may continue working while their renewal application (Form I-765) is pending with USCIS under specific conditions:
Eligibility Criteria for Automatic Extensions
To qualify for an automatic EAD extension, the applicant must meet two key requirements:
- Timely Filing: Properly submit Form I-765 for an EAD renewal before the current EAD expires.
- Valid Nonimmigrant Status: Hold an unexpired Form I-94 verifying valid H-4, L-2, E-1, E-2, or E-3 status.
Duration of Automatic Extension
The automatic extension remains valid until the earliest of the following:
- The expiration date of the applicant’s unexpired Form I-94;
- The date USCIS formally approves or denies the pending Form I-765 renewal application; or
- 180 days from the “Card Expires” date listed on the previous EAD card.
Required Documents for Form I-9 Reverification
To document an automatic extension for an employer, the employee must present:
- The expired EAD card reflecting category A17 (E-1/E-2/E-3), A18 (L-2), or C26 (H-4);
- Form I-797C (Receipt Notice) for the timely filed Form I-765 showing the matching eligibility category; and
- An unexpired Form I-94 indicating valid H-4, L-2, or E nonimmigrant spouse status.
3. How Often Must EADs Be Renewed?
- L-2 and E Spouses: Do not need to maintain or renew an EAD card to remain authorized to work, provided they maintain valid L-2S, E-1S, E-2S, or E-3S status documented on an unexpired Form I-94.
- H-4 Spouses: Must file Form I-765 to extend their EAD card in alignment with their underlying H-4 status validity period (typically granted in increments of up to three years). Form I-765 renewal filings can be submitted up to 180 days prior to the current EAD expiration date.
