Successful B2 Extension! We recently secured a full six-month I-94 B2 extension for a parent of a green card holder, enabling them to extend their stay in the United States for an additional 6 months. This allows them to attend a family event scheduled later in the year. USCIS does not easily grant B2 extensions.
To extend their B2 status, we filed Form I-539 with US Citizenship and Immigration Services (USCIS) and supporting documents before the original I-94 expiration date. To check your I-94 record, visit Get Your Most Recent I-94.
USCIS approved the I-94 B2 extension for 6 months (maximum allowed under the regulations) without a request for further evidence (RFE).
The B2 extension processing time was 2 months from submission to approval and issuance of updated I-94 reflecting the extension.
Key Factors for Success:
- Timely Filing: We submitted the I-539 application with supporting documents while the parent maintained valid B2 status.
- B2 Extension Documentation: The application package, included the following B2 extension documents:
- A detailed letter explaining the specific reason for the extension (family event).
- Proof of applicant’s financial ability to support themselves in the United States for the 6-month extension requested
- A return ticket.
- All required forms and fees.
- Complete Initial Application: The extension was approved without a Request for Further Evidence (RFE), minimizing delays.
- B2 Extension Processing Time: USCIS approved the extension within 2 months of filing.
- Valid B1/B2 Visa & I-94: The parent held a valid 10-year B1/B2 visa and had a valid I-94 with B2 status at the time of application.
