We recently had H-2B visas approved for cooks for a restaurant in Florida for the first half of FY2023 starting on October 1, 2022. USCIS approved the H-2B visas within 1 week with premium processing and the employer had a labor certification from the U.S. Department of Labor. The H-2B visa program allows a US employer to bring temporary workers to the United States on H-2B visas to work during its period of need, based on a seasonal, peak load, intermittent or one-time occurrence need.
The H-2B visa program is designed to help U.S. employers that encounter difficulties hiring due to shortages of U.S. workers that are willing and able to perform nonagricultural work. The program is available only to nonagricultural workers from countries that participate in the H-2B visa program. There are 66,000 H-2B visas available each year and the U.S. company that is interested in using the program to temporarily fill positions must obtain a labor certification from the U.S. Department of Labor within a regulatory timeframe.
